On January 4, 2018, our firm filed a Complaint (see attached) on behalf of the Plaintiff, Mr. Cessna, for Civil Penalties under the Labor Code Private Attorneys General Act (PAGA) of 2004, Labor Code 2698, et seq., against Southern California Edison (hereafter sometimes referred to as “SCE”).
This case is being brought on behalf of Technical Planner 2 employees of SCE who worked in California at any time since October 2, 2016.
In his lawsuit, Plaintiff contends that Southern California Edison did not comply with the requirements under California law, and specifically failed to provide those employees with payment for all hours worked, including overtime wages.
Plaintiff has also pleaded in his complaint that SCE failed to provide adequate off-duty meal periods and meal period compensation and for rest periods and res period compensation.
Further, Plaintiff claims that as a matter of policy, Southern California Edison knowingly and intentionally provided Plaintiff with wage statements that, among other factors, don’t show all wages earned, all hours worked, or all applicable rates.
Plaintiff also contends that, as a matter of policy and/or practice, SCE failed to pay Plaintiff all wages due and owing upon termination of employment, including, but not limited to payment of wages for off-the-clock work, overtime compensation and missed meal and res periods compensation.
The court has not yet ruled on any of Plaintiff's allegations or determined whether the case is appropriate for class action status.
If you are now such an employee, or were an employee of Southern California Edison in California since October, 2016, we would like to speak with you.
You may have documents relating to your job there, such as copies of checks, schedules, pictures of your training requirements or materials, forms you had to sign, manuals, emails, letters, time-sheets, or instructions about training, etc. If you could provide those to us, it might help us and others to see them.
