Herman Lu v. AT&T Class Action Lawsuit

In this case Mr. Lu attempted to represent all California AT&T employees who, like Mr. Lu, believed they were owed on-call wages (a class action). Unfortunately, the court did not allow the claims to be made on behalf of a class.

Employees who believe they are owed for unpaid on-call time may still pursue their own on-call wage claims individually. You are free to contact an attorney to discuss your rights if you feel you are owed on-call wages. Be aware that there are time limits to pursue a claim, called statutes of limitations, so you should act promptly or you may have waived any right to seek back wages.

Plaintiff's Allegations

A proposed class-action lawsuit has been filed by former employee Herman Lu ("Plaintiff") against AT&T Services, Inc., etc., on behalf of current and former employees of defendants who were employed in California as "on-call" employees at any time since December 29, 2006. The case is entitled Herman Lu v. AT&T Services, Inc., et al, , Case No. CV-10-5954 (United States District Court, Northern District of California).

In this lawsuit, filed on behalf of himself and all others similarly situated, Plaintiff Lu contends that AT&T did not comply with the requirements under California law for payment of wages. If successful, a class action allows former and current employees to receive back wages that are owed to them.

The court has not yet ruled on any of Plaintiff's allegations or determined whether the case is appropriate for class action status.
