JUDGE GRANTS REQUEST FOR FINAL APPROVAL OF CLASS ACTION SETTLEMENT!
While it's taken more time than we wished, thanks to our being able to talk with many of you throughout the past few years, we are grateful that we can report this result.
We're very pleased and grateful to announce that the Honorable Dierdre Hill, Judge of the Los Angeles County Superior Court, granted plaintiffs’ motion for final approval of the class action settlement entered into between the parties.
To those of you who helped us reach so many of the class members, we thank you all for your efforts and assistance.

We want to say thanks to all of you, and especially Estelee Daley, for the results achieved on behalf of the class.
Over 82% of the class filed claims, and they constituted over 95% of the workweeks which comprised the class period.
We will be returning to court to file a motion for final approval, hopefully to be heard next month. We'll let you know of any further developments.

Claim Forms MUST BE FILED by Monday! More than 80% of the Class Has Already Done So!
If you’re reading this and it’s not yet August 7, 2012, you can still file a claim form if you’re a member of this class.
Don’t miss out. If you’ve been putting it off, put it off not a moment longer. More than four-fifths of your colleagues have already done so.
As of today, more than 75% of the class members have already filed their claims with Simpluris, the third party claims administrator handling this case. If you are a class member, you only have until early next month, on Monday, August 6, 2012, in order to file your claim.
THERE ARE ONLY FOUR DAYS LEFT TO FILE A CLAIM!!!

For those of you who have turned in your forms, if you know of any of your colleagues who have not received their claim forms, or are unsure, you might want to explain to them why you felt it was wise to file a claim.
All of you who have helped us find others? Terrific! Outstanding! Keep it up! Thanks for all of your efforts. Because of your help, people are filing for whom our information was totally out of date.
And if you are one of those who hasn’t yet filed? Don’t be left out. We firmly believe the court will grant us final approval next month. If we’re right, we expect that those who file their claims should receive checks later this year. If you’re a class member, we definitely hope you will be one of those receiving such a check.

We are pleased to announce that the court granted our Motion for Preliminary Approval of the Settlement reached between the Plaintiffs and Defendants (a copy of the court’s order is attached hereto).
As a result, Claim Forms were mailed out to class members in this case last week, June 20, 2012. Claim Forms MUST BE submitted to the Claims Administrator, Simpluris, by August 6, 2012.
If you have not received your claim form, and you worked as a Family Services Counselors for Rose Hills Mortuary, L.P. in California since November 10, 2009 and you believe yourself to be a member of the class you should contact Simpluris, IMMEDIATELY. IMPORTANT - We recommend, when you mail back your completed form, that you BE SURE to keep a copy of the completed form in a safe place. Treat it like a check.
We also strongly recommend that you mail it Certified Mail, and Return Receipt Requested. Be sure to keep both the receipt you get at the post office, and the return receipt when it’s signed for, in a safe place as well so that if your claim is somehow lost, you will be able to show you submitted it on time.
To help us administer the claim, we would be grateful if you would mail, email or fax us a copy of your completed claim form as well. HOWEVER, it MUST BE filed with Simpluris, the Claims Administrator BY AUGUST 6, 2012.
A proposed class-action lawsuit has been filed by Estelee Daley ("Plaintiff") against ROSE HILLS MORTUARY, L.P., SKYROSE CHAPEL FOUNDATION AT ROSE HILLS MEMORIAL PARK, ROSE HILLS COMPANY, ROSE HILLS MEMORIAL PARK & MORTUARY, on behalf of employees holding such titles as inside salespersons for Defendants in California, including but not limited to the job titles of Advance Planning Counselor and Family Service Counselor, at any time during the four years preceding the filing of the lawsuit on November 10, 2009. The case is entitled Estelee Daley v. Rose Hills Mortuary, et al, Case No. BC 425654 (Los Angeles County Superior Court).
In this lawsuit, filed on behalf of herself and all others similarly situated, Plaintiff Daley contends that Rose Hills, etc., did not comply with the requirements under California law for payment of wages. If successful, a class action allows former and current employees to receive back wages that are owed to them.
The court has not yet ruled on any of Plaintiff's allegations or determined whether the case is appropriate for class action status.
