Robert Mendez v. R+L Carriers, Inc., and R+L Carriers Shared Services, LLC - Class Action Lawsuit

The Mendez v R+L Carriers, Inc. case has concluded, and we sincerely thank all of you who helped us prosecute that matter to where we got what we think was a great resolution for all.

We are now in the process of prosecuting other cases involving truck driving, and will have that information up on our website soon.

Update: March, 2014 - Court Grants FINAL Approval of Settlement of Case!

We are pleased to announce that our case has been settled and the settlement was approved by the court earlier this month.

As a result, distribution should take place sometime in the near future.

We are grateful for all of those class members who had faith in us as we worked through this case.

Update: January, 2014 - Court Grants Preliminary Approval of Settlement of Case!

We are pleased to announce that our case has been settled and the settlement was approved by the court last month.

As a result, Notices have already gone out to the class.

IF YOU BELIEVE YOU ARE A MEMBER OF THE CLASS (i.e,. if you drove a truck for R+L Carriers, Inc. since May, 2007 in California) you should immediately contact the Third Party Aministrator, Rust Consulting, Inc. (contact person, Project Manager Amy Tadewald), at 612.359.2031 (direct number). Rust Consulting is located at 625 Marquette Ave., Suite 880, Minneapolis, MN 55402.

We have also attached a copy the Order of the Court signed by the Honorable Claudia Wilkens, Judge of the United States District Court, granting preliminary approval, along with the Stipulation of Class Action Settlement for your review.

Update - September 2, 2013

Since the Court granted our Motion to Certify the Class Action, we’ve continued to work on the case.

Because of confidentiality reasons, we’ve not been able to report anything that has happened since that happened.

However, we’re hopeful that we’ll be able to give you an update in the near future.

To those of you who helped us reach so many of the potential class members, we thank you all for your efforts and assistance.

If you’re reading this and you haven’t let us know of your employment at R+L as a driver in California during the past six years, please contact us now.

If you have any questions or comments, please don't hesitate to call.

In particular, we want to try to make sure we know of all such employees. Even if you're driving for another company now, you or they may still be in the class.

So if you know of anyone who isn't aware of the case, or if you have anything you feel we should know, please let us know, and especially if you've stopped working at R+ to go somewhere else.

Plaintiff Allegations

A proposed class-action lawsuit has been filed by Robert Mendez ("Plaintiff") against R+L Carriers, Inc., and R+L Carriers Shared Services, LLC (hereafter, referred to collectively, as "R+L"), on behalf of all DRIVERS who worked at any of Defendants' locations in California at any time prior to to May 20, 2011, and continuing until the conclusion of the class period. The case was filed in United States District Court, Northern District of California, Case No. CV 11-2478 (a copy of the complaint is attached).

In this lawsuit, filed on behalf of those class representatives and all others similarly situated, Plaintiffs contend that Loya did not comply with the requirements under California law for payment of wages. If successful, a class action allows former and current employees to receive back wages that are owed to them.

The court has not yet ruled on any of Plaintiff's allegations or determined whether the case is appropriate for class action status.

If you worked for R+L as a Line Haul, Long Haul, Flex Class A, City Class A, City Class B, City Class C, Percentage Class A, Percentage Class C, Combo AND/OR P&D Driver AND/OR you drove a truck of any type for R+L - no matter what your title - in the State of California since May 20, 2007, we would like to speak with you. Maybe you have records of time worked off the clock, for instance, before or after you arrived at your first appointment, and which your terminal, district or regional managers were aware.
