Garcia v. Iron Chef, etc.


Plaintiff's Allegations Re Unpaid Wages and Missed Breaks, etc., against Tobe Staff Resources, Corp., DBA Iron Chef

Our office has recently joined with Linda Lara of the Lara & Luna firm in filing a Private Attorney General Action (“PAGA”) on behalf of Veronica Garcia against Tobe Staffresources, Corp., doing business as “Iron Chef”, doing business as “Lunasia”, AHMC Healthcare Inc., AHMC Greater El Monte Community Hospital, LP, and AHMC Inc. (hereafter, “defendants”),  for unpaid wages arising out of her employment with that entity.  A PAGA case somewhat like a class action but is technically different under the law. This case only covers time worked going back to a year before we filed that complaint in April 14, 2017 (so it covers from April 14, 2016 forward).

Ms. Garcia worked as a dietary employee, and seeks to represent those current and former hourly non-exempt employees who worked as food service workers, including but not limited to dietitians, diet aides, dishwashers, cooks, nutritional ambassadors, and cashiers.

We allege that defendants failed to provide these employees with legally compliant work-free meal and rest breaks, failed to pay minimum wages and overtime wages, and failed to compensate such employees for all wages earned and to accurately report all wages earned, and hours worked.  Please see attached complaint for details.

At this point you can do one of several things if you have worked for Tobe Staffresources, Corp., DBA Iron Chef, etc., in the past four years or so.  You can help us by calling or emailing us, and providing us with the names and contact information of your fellow employees.

Or you can call any other attorney to talk about that as well.  Or you can request help from the Labor Commissioner.  Or you can do nothing at all.  It’s up to you.

If you do want to do something to possibly help you and such employees, however, we recommend you either call us at 818-547-5200 to find out more about your rights and the requirements for you to go ahead with such a case.

If you do nothing, you may get nothing for such unpaid wages, especially if you stopped working for defendants in California before April 2016 and you were doing the things alleged in our complaint.
