We have recently associated in as co-counsel (along with the Law Office of Eugene Lee) in a proposed class-action filed by Dr. James Ho-Jin Hwang ("Plaintiff") against California Institute of Technology ("Cal Tech."). The case is filed on behalf of all individuals employed by Cal Tech in California who were provided WARN Act notices and whose separation pay defendant calculated by deducting payments made under the California WARN Act in the four years prior to the filling of the complaint, i.e., July 6, 2007 (complaint filed July 6, 2011). The case is entitled James Ho-Jin Hwang v. California Institute of Technology, et al, Case No. BC 464894 (Los Angeles County Superior Court).
If an unpaid wage class action is successful, it allows former employees to receive pay that is owed to them.
The court has not yet ruled on any of Plaintiff's allegations or determined whether the case is appropriate for class action status.
