Cases and Class Actions » Oard v. Daily Press - Independent Contractor Driver/Deliverers
Even before the date formerly set for hearing next week, the Court, the Honorable Stephen V. Wilson, granted our Motion for Final Approval approving our Class Action Settlement on November 15, 2018.
Disbursement of the funds will be made by Phoenix Class Actions Administration Solutions, the Third Party Administrator for this case.
As in all of our cases, we remind you, if you believe you qualify to be a class member in this case, to please be on the lookout for a check.
In particular, if you have moved since you began employment with Daily Press, your check might be misaddressed, misdelivered or lost in the mail. So if your are a class member, be sure to watch your mail for a check, beginning around the middle of next month or so.
If you do not receive your check by the end of December, 2018, please contact Phoenix, the third-party administrator which is coordinating the mailing of the payments to the class. You may call Phoenix at (800) 523-5773.
Another reminder. You will only have 180 days to cash your check as set forth in the settlement. Please keep that in mind. Some people hold on to them, not wanting to cash them for their own reasons, perhaps - but you and they have to keep that time limit in mind.
Finally, be sure to call our office if you have any questions about your employment with Daily Press or regarding any other employment matter you might have now, or have had in the past. Perhaps we can assist you, your friends or family in that regard as well.
Call us at 626-795-0205 or 818-547-5200. Or email me at Tom@falveylaw.com.
Thanks very much for your patience in helping us see this matter through to a very successful conclusion.
Because of a slight delay in the court granting our motion for preliminary approval, the notice that many of you have been expecting have not yet been mailed out.
We now expect they will be mailed out next month, hopefully by the third week of August.
If you feel you are a potential class member and don’t get any mailing by the last week of August, please contact Phoenix Settlement Administration at 800-523-5773.
If you have any questions or comments about this case, please call us at 818-547-5200, or you can also email us at email@example.com.
Thanks very much. If you have any other questions or comments on your employment elsewhere, we’d also be glad to hear from you.
If you worked for Daily Press delivering newspapers and magazines in California at any time since November 2011, we should have gotten your name.
If so, you should be getting a letter from our office sometime this week.
If you don't get that letter, please call us at once at (818) 547-5200, so we can update our files, and talk about what this case might mean to you.
Thanks very much. We hope to hear from you soon.
On November 3, 2015, our firm filed a proposed class-action lawsuit in San Bernardino County, case no. CIVD81516106, against Daily News LLC, and Local Media Group, Inc., on behalf of Newspaper Carriers who worked in California since November, 2011. A copy of the complaint is attached here. It was later removed to federal court and is now designated as case no. 5:16-cv-02039-SVW-KK.
We held off on putting this case up on our website because defendant Local Media Group tried to get the case dismissed via bankruptcy. After a long period of time and filings, the bankruptcy court released us from the bankruptcy proceeding, such that our case is now pending in federal court. We are currently in the process of attempting to have the case put back in state court, where it was originally filed.
Whether the court will grant our request will be determined, we believe, sometime in November, 2016.
This case is filed on behalf of individuals who worked as independent contractors in California as drivers or deliverers or other similarly situated non-exempt employees for Local Media Group at any time since November 3, 2011.
In his lawsuit, Plaintiff contends that Local Media Group did not comply with the requirements under California law for payment of wages. If successful, a class action allows former and current employees to receive back wages that are owed to them.
The court has not yet ruled on any of Plaintiff's allegations or determined whether the case is appropriate for class action status.
If you are or were an employee of Local Media Group in California since November, 2011, we would like to speak with you. Please contact us by either calling our office at 818-547-5200, by mailing us at 550 North Brand Blvd., Suite 1500, Glendale, CA 91203. You may also email us at firstname.lastname@example.org.
Thanks very much. We hope to hear from you and your fellow workers soon.
