Update 12/28/16 - Checks are - Literally - In the Mail

Great News!  The checks for class members have been mailed out in the settlement of all six of these class action settlements filed on behalf of CVS pharmacists throughout the State of California.

If you know or believe you were a member of this class, you should look for your check in the mail to arrive within the next week or so.

PLEASE REMEMBER: Maybe CVS no longer had a current address for you.  Have you moved?  Does CVS know of your latest address?  It might not.  It might make a mistake in the address, such as the wrong number or a misspelled street.  It might not have the right apartment or unit number, or might leave it off altogether.

People have even been known to believe the checks were fakes, a trick, and not believe they actually got such a check.

AND - You need to cash that check within SIX MONTHS of its being issued.  Sometimes people just hold onto the checks, thinking they can cash them at any time.  That’s not the case here.  Please keep that in mind.

SO.  If you haven’t got it yet, BE SURE - if you’re in the class - to look for it over the next two weeks.  If you don’t get a check by, let’s say, January 15th, please call KCC, the third party administrator, at (415) 798-5913 and inquire about your address and status as to whether you’re a class member and the check status.

Update 11/30/16 - Motion for Final Approval of Class Action Settlement Granted

Great News!  All six class action settlements were granted final approval for pharmacists who worked as floaters while employed by CVS in California during roughly the past five years.  

We are grateful to all of those of you who called and emailed us and helped us prepare our case.  Our being able to talk with many of you really helped us achieve a very good result. 

It’s always a pleasure when we can report this result.

UPDATE August 8, 2016 - Preliminary Approval Granted in CVS Floater Cases

After a long period of negotiations, we’re pleased to announce that the Los Angeles Superior Court recently granted our Motion for Preliminary Approval of our settlement in ALL SIX class actions we brought against CVS on behalf of floater pharmacists who worked in California during roughly the past 7-8 years.  A copy of the court’s order is attached hereto.

KCC, the third party administrator for all six cases, will be mailing out notices to all known class members on or about August 29, 2016.  If you believe you are part of the class you should receive such a notice.  CVS may not have your current address, and thus the administrator might not mail it to where you live.

UPDATE June 24, 2016 - We now expect the Motion for Preliminary Approval Filed for all 6 Regions in California to be heard in July.

We said this before and again apologize, but the fact is, for a variety of reasons, we keep going back to the drawing board in trying to get preliminary approval of our settlement on these cases.

We anticipate, however, that a motion for preliminary approval of settlement will be heard sometime within the next month.

UPDATE October 15, 2015 - Motion for Preliminary Approval Filed for all 6 Regions in California Expected to be filed in near future.

We apologize for not providing any updates on these cases, but the fact is, many starts and stops and delays and unanticipated glitches arose in trying to resolve these cases.  Simply stated, they have proven much more difficult than the ‘7-day’ cases in many ways.

We anticipated, however, that a motion for preliminary approval of settlement will be filed sometime within the next month.

Update - November 17, 2013

Since the filing of the case of Stark v CVS, our offices have filed four more cases on behalf of pharmacists who worked for CVS in California in the last several years. They include the cases of Heiati v CVS (Region 54), Woods & Akmal v CVS (Region 60), Ibrahim v CVS (Region 72) and Schwartz v. CVS (Region 73).

If your are a pharmacist who worked for CVS in California during the past four to five years and you worked in one of those regions, you may be a possible class member in one of those cases. Update July 10, 2013

As you may be aware, we have filed several class actions on behalf of pharmacists who either worked as “Floaters” or who may have “floated,” i.e., worked in more than one store on a non-regular basis (which could be many stores over a period of time) for CVS during the past five years in California for unpaid wages. This includes those pharmacists who worked in Regions 54 65, 72, and in regions up north.

Because of the manner in which CVS sets up its regions, we believe we have not been made aware of the names of all individuals who worked in that capacity. Thus if you were employed as a pharmacist in California for CVS during the past five years or so, and worked as a floater - whether you had that title or not - we would appreciate your calling us in hopes that we can determine whether you should be included in this case, and to assist us in the process.

Work a 7-Day or 'Graveyard Schedule?


Our firm recently filed a new class action on behalf of CVS pharmacists who worked as floaters for CVS in California. That case, entitled Ian H. Stark v. V CVS Pharmacy, Inc., etc., was filed in the Los Angeles County Superior Court, as Case No. BC 476431.

We have since filed five additional cases regarding CVS floaters, so that all CVS regions in the State of California are now included in our lawsuits..

If you are now or were employed as a CVS pharmacist who ‘floated’ in California since 2009 and believe you might be a member of this case, please feel free to contact our office.

Even if you were a class member in the previous CVS class action, concluded in 2008, you may well be part of this case as well.
