As you may be aware, the Dillon’s location in Hollywood closed last month. In spite of that fact, we are pursuing the case. Our Motion for Class Certification is scheduled to be heard June 12, 2013 and trial is set to begin June 17, 2013.
In the meantime, if you were a server, hostess or bartender at Dillon's at that location during the past four years, we would like to hear from you as we prepare for trial. In particular we would like to know what hours you may have worked, for which you feel you were not compensated, e.g., before or after your shift, or at meetings, or while waiting for the cashiers to be counted out.
It might be that you could assist us by testifying at trial. Similarly, you might be able to help us locate other class members. You might have information of which we are not aware at all. We have recently joined with the Huron Law Offices in representing Bartenders, Servers and Hostesses of Dillon’s Irish Pub in a claim for unpaid wages and other damages. The case was originally filed on behalf of Natalie Sutherland, Lauren Kraft, Elizabeth Bell, Erica Ness and Misty Swain on behalf of themselves and all others similarly situated against Green Guys1, dba Dilon’s Irish Pub, aka Dillon’s Irish Pub & Grill, etc.
In doing so, we’ve recently taken the deposition of Omar Moss.
Mr. Moss has made certain statements about which we would like to interview you if you held the position(s) of Bartender, Server and/or Hostess since September, 2009, and worked at either Dillons location, i.e., in Hollywood, or Chino Hills.
You should also know we’ll be filing a Motion for Class Certification in December, and thus would appreciate your calling our office if you held any of those positions during the past three years.
Likewise, we’d be grateful if we could review any paystubs, clockout receipts, emails, schedules, timesheets, employee manuals, and any other documentation relating to your employment.
