Update: August, 2022 – Motion for Class Certification Scheduled for October 14, 2022!
Did you work for San Gabriel Transit since February of 2010? Over 500 people did. If you did work for them, we have filed a complaint – a lawsuit – that you weren’t paid overtime, or for meal or rest breaks, or for missed meals or rest breaks.
Our case is set to be argued before the court in about 2 months. Do you have any documents, texts, photographs, manifests, logs, rosters, employee phone numbers or names you can provide us? Could you take a look at your phone contacts? Maybe you have the names and numbers for some people who drove for San Gabriel Transit. If you have any of those things, you might be able to help us win our case.

Update: September, 2021 – We Won the Appeal!
We’re glad to report that the court ruled in our favor on the appeal, and we are again proceeding with our case.
Because of the ruling by the California Supreme Court on another case, the court in our case will be determining how we can proceed.
We hope to have a hearing on our case later this year, and will be keeping you informed as further facts arise.
In the meantime, if you have any new information you can provide regarding your work as a San Gabriel Transit driver – SINCE 2010 – THAT’S RIGHT – SINCE 2010 – please let us know as soon as possible.

Great News! Our Appeal Got Our Case Up and Running Again!
It’s been about FOUR years since the court denied our motion for class certification. Finally, the court of appeal decided that our case can move forward once more.
This does not mean that we have won the case. It does mean that we have a chance at winning, depending on what happens in the future.
Did you work for San Gabriel Transit after February, 2010 for either San Gabriel Transit or Southland Transit or Black Car? If so, you may still be able to help us in our case! Are you working for them now, or any other company which you feel has or is mistreating you or friends or family?
Please let us know if that’s happening. Or if you have any schedules, or earnings statements or texts or emails or hand-outs from any employer relating in any way to your work.

Update: January, 2019 – Appeal Still Awaiting Hearing
Several of you have called, asking the status of this case and the appeal that we filed after the court’s ruling a while ago.
Simply stated, for a variety of reasons, the appeal has still not been heard on this case. We’re hoping it will be decided this year, and thank you for your patience in awaiting its outcome.
Having said that, we urge those of you who are potential class members to keep in touch concerning your employment, anything you might feel needs being discussed regarding your employment, and contact information for any employees who may not be aware of our case.

Update: May 31, 2017 – Notice of Appeal Filed RE Denial of Motion for Class Certification
Unfortunately, the court denied our Motion for Class Certification, so we are now proceeding with an appeal to seek a reversal of that decision.
While there is no guarantee that we will be successful, we would not be taking this action if we didn’t believe in the validity of our case.
We will continue to keep you posted as new developments arise. In the meantime, if you have any questions or comments about your employment, either with San Gabriel Transit or any other employer, please feel free to call us.
Update: May 16, 2016 – We are Set to Mediate the Case – Can You Help?

Update: November 7, 2015 – Letters have gone out to potential class members. Have you gotten yours?
If you worked for San Gabriel Transit (“SGT”) since February of 2010 – that’s right, during the last five and a half years – you might be entitled to be part of this case.
Did you get our letter? We sent it out to all of those for whom we had names and addresses. BUT .. MAYBE … if you moved, the address given to us by SGT is no good, so you couldn’t get our letter. Or maybe we got a wrong address. That happens.
So please contact us if you haven’t gotten a letter or call from our office.
ALSO .. Stacey Murphy has been deposed. Did you deal with her? Did you have disagreements with her or anyone else at SGT about your pay or assignments?
Or having to pay for the weekly lease on weeks when you didn’t use the car?
Or for life insurance? Did you ever see that Life Insurance Policy?

Update: March 23, 2015 – San Gabriel Transit Required to Provide Names
The court has required San Gabriel Transit to provide us with the names of those people who drove for San Gabriel Transit in California during the past five years.
As a result, if you drove for San Gabriel Transit during that time, you should get a letter from us very soon.
If you do not get such a letter, please call us. Maybe you’ve moved and the letter won’t get to you. Or maybe San Gabriel Transit put down the wrong address by mistake. Or maybe they left your name off the list.
Either way, we want to know if you ever felt you were not paid for all miles you drove. Also, we want to know if you ever got a 1099 or a paystub. We also want to know if you had to pay for insurance, whether it was for health or accident or anything else, for which you didn’t get anything at all.
We’d also like you to help us find other class members. You might have information of which we are not aware at all. If you believe you can help in any way, please give us a call at your earliest convenience. Thanks very much. We hope to hear from you soon.
Gonzales v. San Gabriel Transit – Plaintiff’s Allegations
A proposed class-action lawsuit has been filed by Francisco Gonzales (the Plaintiff) against San Gabriel Transit (the Defendant).This case is for Mr. Gonzales and individuals who worked as Drivers for San Gabriel Transit in California at any time during the four years preceding the filing of the lawsuit on February 14, 2014 and amended on July 22, 2014. The case was filed in Los Angeles County Superior Court as Case Number BC 536584 (a copy of the Complaint is attached).
In this lawsuit, filed on behalf of themselves and those people who worked at the same job, Plaintiff claims that San Gabriel Transit did not comply with California law for payment of wages, by claiming that those driving for San Gabriel Transit were not employees, but misclassified them as independent contractors. If successful, a class action allows all such individuals to receive back wages that are owed to them.
The court has not yet ruled on any of Plaintiff’s allegations or determined whether the case is appropriate for class action status.
