CPT is the Third Party Administrator for this case, and handles all distribution of funds.

Update: April 2019 – Court Grants Final Approval of Settlement of Case!
The court has recently given us final approval of our settlement of this case earlier this month. We are grateful for the resolution of this matter.
Because of requirements of the settlement, payments are not scheduled to go out to class members until July, 2019. Thereafter, the checks will be valid for only 60 days, so be sure to watch for your check, and cash or deposit it, etc., as in the time forth in the documentation you will receive with the check.

Update: November 5, 2018 – Motion for Preliminary Approval of Settlement Filed with the Court!
You’ll be glad to know we have filed our motion requesting the judge approve our settlement with True Food Kitchen and Fox Restaurant Concepts.
The matter is scheduled to be heard in early December, and we are, of course, hopeful that the court will rule in our favor. Be sure to watch our website for further developments.
In the meantime, of course, we’d be glad to hear from you if you believe that you are a potential class member in this case. You may be able to provide additional information, not only about your employment at True Food Kitchen, but in regard to any class members who may have moved, and may not know of the pendency of the possible settlement.

Update: August 11, 2017 – LOTS of you have MOVED!
After we got the list of employees (almost every one of you wanted to know about the case, and did NOT opt out of hearing from us), we sent out letters to the addresses we were given by True Food Kitchen.
A LOT of them have come back, with a notation “not known at this address.”
So either True Food Kitchen didn’t have correct addresses, or a large number of its former employees – because after all, it would have current addresses for its employees, right – have moved.
Now this case goes back more than five years. So maybe a lot of those employees at Fox Restaurant Concepts (True Food’s other name) who worked at one of its restaurants in California back in 2012 – through 2016 or so did move and so there’s no forwarding address. (The post office doesn’t keep them that current any more.)
SO. We need your help. If you worked at True Food Kitchen in California during the past five years, you undoubtedly have names and contact information in your phones.
Do you want to help us? Please do! Please send us the names and phone numbers of anyone else you know who would want to learn about our case. AND/OR call them and tell them to contact us.

Update: May 6, 2017 – Mailing Of Post Cards To Potential Class Members Has Gone Out!!
As a result, within a month or so we can contact you individually, because we’ll finally have your names.
We filed this case not quite a year ago on July 22, 2016. Sometime within a month or so we should have the contact information for all of you who might be a potential class member in this case.
We’ve been told that there are almost 2,000 class members, going back about roughly four and a half years. So the turnover is pretty high. Perhaps as high as 50% annually.
That means a lot of you – if you’re a class member – might want to talk to us about how you were treated in terms of getting paid, or not getting paid for working late.
Some employers act like they really have the employees’ best interest in mind. But then the employer is saddled with supervisors who care nothing about the employees, and everything about the bottom line – and their bonuses. Maybe you’d want to tell us about those general managers or assistant general managers or anyone who you felt took advantage of the staff.

Plaintiff’s Allegations
Our firm has joined with the Law Offices of Alex Hartounian in filing a proposed class-action lawsuit by former employee Jennifer Pae (“Plaintiff”) against Fox Restaurant Concepts, LLC, doing business as TRUE FOOD KITCHEN (“TRUE FOOD KITCHEN”)j.
This case is filed on behalf of non-exempt restaurant employees in California who have worked as servers, waiters, waitresses or other similarly situated non-exempt employees at any Fox Restaurant Concepts restaurant at any time since July 22, 2012.
In her lawsuit, Plaintiff contends that TRUE FOOD KITCHEN did not comply with the requirements under California law for payment of wages.. If successful, a class action allows former and current employees to receive back wages that are owed to them.
TRUE FOOD KITCHEN has not yet responded to the complaint as of July 25, 2016. The court has not yet ruled on any of Plaintiff’s allegations or determined whether the case is appropriate for class action status.
