Update: May, 2019 – FINAL APPROVAL GRANTED and CHECKS MAILED OUT!

Update: September, 2018 – Motion for Preliminary Approval GRANTED!

Yes!!  The court has granted our motion for preliminary approval of settlement of this case.

Please be patient, however.  The hearing on the Motion for FINAL Approval will not take place until early next year, as shown on the attached order of the Court.

If you’re a member of this class, you should be getting a notice of the terms of the settlement sometime next month.  If you don’t receive such a notice, it might mean your notice was misaddressed, or lost in the mail, or for some reason you weren’t included in the mailing.

Update: August 5, 2018 – Motion for Preliminary Approval Filed!

We wanted you to know!  We’ve filed a motion for preliminary approval of a potential settlement of this case, currently set to be heard September 6, 2018.

While the court has not yet ruled on this motion, we’re hopeful to have a decision to you sometime next month, or in the near future.

Update: December 5, 2017 – Galpin hopes to push the case into Arbitration

Galpin Is hoping the court will force this case into arbitration, and in the process try to limits its damages.

Can we ask you to please do us and Galpin workers a big favor?

Have you worked for any of the Galpin companies, e.g., Galpin Motors, Galpin Jaguar, Galpin Lincoln-Mercury?

Cressall v Galpin Motors – New Private Attorney General Action (PAGA) filed August 3rd, 2017

Earlier this month our firm filed for Civil Penalties under the Labor Code Private Attorneys General Act  (PAGA) of 2004, Labor Code 2698, et seq., in Case No. BC671021, against Galpin Motors, Inc., Galpin Jaguar Lincoln-Mercury, Inc., and Galpin Honda (hereafter, collectively, “Galpin”).  A copy of the complaint is attached here.

In his lawsuit, Plaintiff contends that Galpin did not comply with the requirements under California law, and specifically failed to provide such employees with payment for all hours worked, including minimum and overtime wages.

Plaintiff has also pleaded in his complaint that Galpin failed to provide adequate off-duty meal periods and payment for missed meal periods, as well as for missed rest periods and failure to pay employees for such rest periods.   

Further, Plaintiff contends that as a matter of policy, Galpin knowingly and intentionally provided Plaintiff with wage statements, that do not show all wages earned, all hours worked and/or applicable rates of pay. 

Plaintiff also contends that, as a matter of policy and/or practice, Galpin failed to pay Plaintiff all wages due and owing upon termination of employment, including, but not limited to payment of wages for off-the-clock work, overtime compensation and missed meal and rest periods compensation.

Galpin has not yet responded to the complaint. The court has not yet ruled on any of Plaintiff’s allegations.
