While we have been hopeful, over the past many months, that we would be able to pursue the matter we filed as a class action, that has not worked out.

We regret this turn of events. However, if you believe you might have been a possible member of this case had it been a class action, and/or feel you were wronged in any other way, you should feel free to take your own action, including seeking out an attorney to represent you on an individual basis.

We thank all of you who tried to assist us in these efforts. If we file any class action case involving this job position in the future, we will post it on this website.


Update: Nov. 7, 2013 – Letters Going Out to Class Members – Watch for Yours!

Our case has now progressed to the point where we have been provided with contact information for those individuals who Schwan has indicated might be in this class, should the court certify it when asked to do so.

PLEASE UNDERSTAND: Sometimes companies such as Scvhwan forget to include all names on such lists that they provide to us for contacting current or former employees. So if you don’t get a letter about this case from us by the end of this month, and you were a Route Salesman who worked as such in California at any time since April 18, 2009, please contact us.

PLEASE ALSO UNDERSTAND. Similarly, addresses may have been entered incorrectly, either by Schwan, its attorneys, and/or our offices, and so the letter might not have been delivered to your home.

LIKEWISE, you might have moved. Or the post office could have delivered the letter to the wrong address. Or you might have thrown it out, thinking it was some sort of ad. Or it might have fallen into a grocery store ad, and you never saw it at all.

FOR ANY OF THOSE REASONS, you might have missed getting that letter, which might be of great benefit to you if your qualify to be in this class.

So if you didn’t get that letter, or you misplaced it, or you threw it away, please contact us, so that we might better inform you about the case, and also perhaps, gain information which will help others such as yourself.

Plaintiff’s Allegations

A proposed class-action lawsuit has been filed by Kelly Anderson (“Plaintiff”) against The Schwan Food Company, on behalf of employees holding the title of Route Salesman who worked for Defendant in California, at any time during the four years preceding the filing of the lawsuit on April 18, 2013. The case was filed in Alameda County Superior Court, as Case No. RGBC 13676229 (a copy of the complaint is attached).

In this lawsuit, filed on behalf of himself and all others similarly situated, Plaintiff Kelly Anderson contends that Schwan did not comply with the requirements under California law for payment of wages. If successful, a class action allows former and current employees to receive back wages that are owed to them.

The court has not yet ruled on any of Plaintiff’s allegations or determined whether the case is appropriate for class action status.
